PCASH Terms of Service
Last modified: September 28, 2026
These Terms of Service (“Terms”) are a legally binding agreement between you and Field Systems LLC (“we,” “us,” or “our”) governing your use of the websites and other services that we operate in connection with PCASH (the “Services”).
By accessing or using the Services, you accept these Terms.
Subject to these Terms, we grant you a limited, non-exclusive, revocable right to access and use the Services.
NOTICE: THESE TERMS CONTAIN AN ARBITRATION PROVISION AND CLASS ACTION AND JURY TRIAL WAIVERS THAT AFFECT HOW DISPUTES ARE RESOLVED.
1. The PCASH Protocol and the Services
The PCASH Protocol is an open-source protocol for a private-value network derived from Ethereum, which third parties can run and access independently of the Services.
The PCASH Protocol itself is not one of the Services. The Services include our websites, our RPC endpoints and node infrastructure, and our transaction relaying infrastructure.
The “PCASH Ecosystem” means the PCASH Protocol, the Services, and the smart contracts, circuits, and software that interact with the PCASH Protocol, whether or not we developed or operate them.
We do not control Ethereum or independent software, infrastructure, or participants that interact with the PCASH Protocol.
2. Eligibility and Sophistication
You may use the Services only if:
- you are at least eighteen (18) years old and legally capable of entering into a binding agreement with us;
- your use of the Services would not violate applicable law or cause us to violate it;
- you are not identified on, or owned or controlled by a person identified on, a sanctions list maintained by the U.S. Department of the Treasury’s Office of Foreign Assets Control or another applicable sanctions authority; and
- you are not located in, organized in, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions.
By using the Services, you represent that you have sufficient technical and financial sophistication to understand and evaluate the risks associated with blockchain, cryptographic, and digital-asset systems, and that you have a working understanding of concepts relevant to your use of the Services, including wallets, private keys, digital signatures, blockchain transactions, transaction fees, digital assets, and privacy technologies.
If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
3. Non-Custodial Services
We do not take custody of your digital assets or private keys.
Connecting a wallet, signing a message, or using the Services does not create a deposit account, brokerage account, or similar financial account with us.
Providing software or infrastructure that constructs, proves, transmits, relays, or publishes an action does not mean that we initiated or authorized that action.
You are responsible for protecting your wallets, private keys, devices, passwords, signatures, recovery information, and other credentials.
You are responsible for reviewing transactions and messages before signing them, and for all messages and transactions signed with your credentials.
You agree not to rely on us to recover lost credentials or assets, or to cancel, reverse, or modify any transaction.
4. Marketplace and Other Users
The Services include an interface for publishing and accepting offers to exchange digital assets between users (the “Marketplace Interface”).
We are not the buyer, seller, merchant, broker, custodian, fiduciary, or agent of either party to a transaction between users.
We do not guarantee the identity, reliability, solvency, performance, or conduct of another user, or the legality, authenticity, quality, value, delivery, or fitness of anything offered through the Marketplace Interface.
A digital asset’s compatibility with PCASH or appearance through the Services does not constitute our endorsement of that asset.
5. Fees, Taxes, and Protocol Economics
Amounts displayed through the Services may be estimates and may change. We may introduce or change fees for the Services.
You are responsible for fees associated with transactions you authorize unless expressly stated otherwise.
You are responsible for determining and paying any taxes that apply to your use of the Services and your transactions, including taxes on digital assets you receive.
Issuance, rewards, fees, payouts, and other economic mechanisms of the PCASH Protocol are governed by the protocol and are not payment obligations owed to you by us.
Fees paid to us are non-refundable.
6. Privacy
Our Privacy Policy describes how we collect, use, and disclose information in connection with the Services.
7. Acceptable Use
You may not use the Services to:
- facilitate fraud, theft, ransomware, money laundering, sanctions evasion, or other unlawful activity;
- engage in market manipulation, including pump-and-dump schemes, wash trading, and so-called “rug pulls”;
- access systems or information without authorization;
- introduce malicious code;
- attack, impair, overload, exploit, or interfere with the Services;
- impersonate any person or project, falsely claim our endorsement, or create or promote a digital asset that misrepresents its issuer, affiliation, or backing;
- violate the rights of another person; or
- materially interfere with other users’ use of the Services.
Automated access and software integrations are permitted subject to these Terms and any technical or rate limits we impose.
You may not use our names, logos, trademarks, or branding in a manner that falsely implies affiliation, sponsorship, or endorsement.
8. User Content
Certain Services may allow you to publish or submit information or materials (“User Content”).
You retain whatever ownership rights you have in your User Content.
You grant us a non-exclusive, worldwide, royalty-free license to use User Content as reasonably necessary to operate, provide, secure, and maintain the Services.
You represent that you have the rights necessary to submit your User Content and that doing so does not violate applicable law or another person’s rights.
We may remove, hide, refuse, or restrict User Content.
9. Assumption of Risk
Using the Services and interacting with the PCASH Ecosystem involve significant risks, including:
- software, specification, or implementation errors;
- security vulnerabilities and cyberattacks;
- cryptographic or proof-system failures;
- loss or compromise of credentials;
- disclosure of your identity or activity through network metadata, public addresses, timing, correlation across services, information you disclose, compromised devices, or software or cryptographic defects;
- irreversible, failed, delayed, reordered, expired, or invalid transactions, or unexpected transaction results;
- loss of digital assets or payment when a multi-step action, such as a marketplace purchase, is not completed before its deadline, for any reason;
- blockchain reorganizations or network failures;
- failures or misconduct of third parties;
- loss of access to Services or assets;
- changes to protocols, software, networks, or law;
- volatility or loss of value of digital assets;
- illiquidity, including the absence of any market for a digital asset;
- counterfeit, malicious, worthless, or misrepresented assets;
- refusal, flagging, freezing, or other adverse treatment by exchanges, financial institutions, or other third parties of digital assets or accounts associated with PCASH or privacy technologies; and
- risks that are unknown or not reasonably foreseeable.
Losses may include the total and permanent loss of your digital assets.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS, KNOWN OR UNKNOWN AND FORESEEABLE OR UNFORESEEABLE, ASSOCIATED WITH YOUR USE OF THE SERVICES AND YOUR INTERACTION WITH THE PCASH ECOSYSTEM, BLOCKCHAINS, DIGITAL ASSETS, AND OTHER USERS, INCLUDING RISKS ARISING FROM ORDINARY NEGLIGENCE BY US OR THE OTHER PERSONS IDENTIFIED IN SECTIONS 14 THROUGH 16.
10. No Professional Advice
You agree not to rely on anything provided through the Services as investment, financial, legal, accounting, tax, or other professional advice, or as a recommendation to buy, sell, hold, create, earn, transfer, or use any digital asset.
You are solely responsible for evaluating your circumstances and the suitability of any transaction.
11. Feedback
If you provide suggestions, ideas, comments, or other feedback concerning PCASH or the Services, you grant us permission to use that feedback without restriction or compensation.
12. Changes and Termination
We may modify, suspend, restrict, or discontinue any Service at any time.
We may update these Terms. Updated Terms will show a new “Last modified” date, and we will give notice of material changes through the Services. Continued use after notice and that date constitutes acceptance to the extent permitted by law.
We may suspend or terminate your access to the Services at any time.
Provisions that by their nature should survive termination will survive.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE PCASH PROTOCOL OR ANY OTHER PART OF THE PCASH ECOSYSTEM.
WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES OR ANY PART OF THE PCASH ECOSYSTEM WILL BE AVAILABLE, SECURE, PRIVATE, ANONYMOUS, ACCURATE, COMPLETE, ERROR-FREE, FREE OF VULNERABILITIES, OR COMPATIBLE WITH ANY PARTICULAR SYSTEM, THAT TRANSACTIONS WILL SUCCEED, OR THAT DIGITAL ASSETS WILL RETAIN VALUE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELD SYSTEMS LLC, ITS AFFILIATES, AND THEIR RESPECTIVE MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, GOODWILL, PRIVACY, OR DIGITAL ASSETS ARISING OUT OF OR RELATING TO THE SERVICES, THESE TERMS, OR YOUR INTERACTION WITH THE PCASH ECOSYSTEM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY OF THEM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FIELD SYSTEMS LLC AND THE OTHER PERSONS LISTED ABOVE ARISING OUT OF OR RELATING TO THE SERVICES, THESE TERMS, OR YOUR INTERACTION WITH THE PCASH ECOSYSTEM, UNDER ANY LEGAL THEORY, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THESE LIMITATIONS APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US.
15. Release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE FIELD SYSTEMS LLC, ITS AFFILIATES, AND THEIR RESPECTIVE MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AGENTS, AND SERVICE PROVIDERS FROM ANY AND ALL LIABILITY, CLAIMS, CAUSES OF ACTION, AND DAMAGES, WHETHER KNOWN OR UNKNOWN, INCLUDING THOSE BASED ON ORDINARY NEGLIGENCE, ARISING FROM OR IN ANY WAY RELATING TO YOUR USE OF THE SERVICES OR YOUR INTERACTION WITH THE PCASH ECOSYSTEM, DIGITAL ASSETS, AND OTHER USERS.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE THE PROTECTIONS OF CALIFORNIA CIVIL CODE § 1542, WHICH PROVIDES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” YOU ALSO WAIVE ANY SIMILAR PROTECTION UNDER THE LAW OF ANY OTHER JURISDICTION.
16. Indemnification
To the fullest extent permitted by law, you will indemnify, defend, and hold harmless Field Systems LLC, its affiliates, and their respective members, directors, officers, employees, contractors, contributors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:
- your access to or use of the Services;
- your violation of these Terms;
- your User Content;
- your violation of another person’s rights; or
- your negligence, fraud, or willful misconduct.
We may control the defense or settlement of any matter subject to indemnification, and you agree to reasonably cooperate.
17. Governing Law and Informal Resolution
These Terms and any dispute arising from them are governed by the laws of the State of New York, without regard to conflict-of-law rules.
Before beginning formal proceedings, the party raising a dispute must give the other party written notice describing the dispute and the relief sought, and you and we agree to attempt in good faith to resolve it informally. You must send notices to [email protected].
If the dispute is not resolved within sixty (60) days after receipt of the notice, either party may proceed as provided below. Applicable limitation periods are tolled during that sixty-day period to the extent permitted by law.
This requirement does not prevent either party from seeking urgent interim relief from a court or emergency arbitrator to preserve the status quo or prevent irreparable harm, or from bringing an eligible individual small-claims action.
18. Arbitration
Except as provided in Sections 17 through 19 or where prohibited by law, you and we agree that any claim or controversy arising out of or relating to the Services, the PCASH Ecosystem, these Terms, or acts or omissions for which either party contends the other is liable, including questions about the scope or enforceability of this arbitration agreement, will be finally resolved by binding arbitration administered by JAMS before one neutral arbitrator.
The Federal Arbitration Act governs this arbitration agreement. The arbitration will proceed under the JAMS Comprehensive Arbitration Rules and Procedures, including the Optional Expedited Arbitration Procedures in Rules 16.1 and 16.2, in effect when the arbitration begins. Where the JAMS Consumer Minimum Standards apply, they control over any conflicting provision of these Terms or those rules.
The arbitration will take place in New York, New York.
Either party may bring an individual claim within the jurisdiction of a small-claims court in that court instead of arbitration.
You and we must keep arbitration proceedings and awards confidential, except as necessary to conduct the proceeding, obtain professional advice, seek interim relief, challenge or enforce an award, comply with law, or exercise rights that cannot lawfully be restricted.
The arbitrator may not consolidate one person’s claims with another person’s claims unless all affected parties agree.
Judgment on an arbitration award may be entered in any court having jurisdiction.
Except for eligible small-claims actions and requests for interim relief under Section 17, if a claim must proceed in court rather than arbitration, the parties consent to jurisdiction in the state and federal courts located in New York County, New York.
19. Class Action and Jury Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WE AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION. THIS PROVISION APPLIES TO CLASS ARBITRATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.
20. Miscellaneous
These Terms constitute the entire agreement between you and us concerning the Services.
If any provision is invalid or unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the relevant business.
We are not responsible for delays or failures caused by events beyond our reasonable control.
Nothing in these Terms creates a partnership, joint venture, agency, fiduciary relationship, or employment relationship between you and us.
Nothing in these Terms waives or limits any right, remedy, or liability that cannot lawfully be waived or limited.
Notices relating to these Terms may be provided electronically.
